§ 97.034. REMOVAL AND REPLACEMENT OF SIDEWALKS, DRIVEWAYS AND CURB RAMPS.

  • (A) Any person who removes existing sidewalks, driveways, or curb ramps shall replace them in accordance with the "Proposed Accessibility Guidelines for Pedestrian Facilities and the Public Right-of-Way" dated July 26, 2011 and the "Department of Justice 28 CFR Part 36 ADA Standards for Accessible Design" dated July 1, 1994 and any updated adopted versions hereinafter. The detectable warning strip shall be of the "cast iron" variety produced by Neenah Foundry, or an equal approved by the City Engineer.
    (B) Any new installations of sidewalks, driveways or curb ramps shall be installed in accordance with the "Proposed Accessibility Guidelines for Pedestrian Facilities and the Public Right-of-Way" dated July 26, 2011 and the "Department of Justice 28 CFR Part 36 ADA Standards for Accessible Design" dated July 1, 1994 and any updated adopted versions hereinafter. The detectable warning strip shall be of the "cast iron" variety produced by Neenah Foundry, or an equal approved by the City Engineer.
    (C) If partial removal of a sidewalk is needed, no less than one entire panel shall be replaced in accordance with the "Proposed Accessibility Guidelines for Pedestrian Facilities and the Public Right-of-Way" dated July 26, 2011 and the "Department of Justice 28 CFR Part 36 ADA Standards for Accessible Design" dated July 1, 1994 and any updated adopted versions hereinafter.
    (D) If more than 40% of a curb ramp is removed, the entire curb ramp shall be replaced in accordance with the "Proposed Accessibility Guidelines for Pedestrian Facilities and the Public Right-of-Way" dated July 26, 2011 and the "Department of Justice 28 CFR Part 36 ADA Standards for Accessible Design" dated July 1, 1994 and any updated adopted versions hereinafter. The detectable warning strip shall be of the "cast iron" variety produced by Neenah Foundry, or an equal approved by the City Engineer.
    (E) If a portion of a driveway is removed and it is in the "accessible path" portion of the driveway and 40% of the "accessible path" is removed, the entire "accessible path" shall be replaced in accordance with the "Proposed Accessibility Guidelines for Pedestrian Facilities and the Public Right-of-Way" dated July 26, 2011 and the "Department of Justice 28 CFR Part 36 ADA Standards for Accessible Design" dated July 1, 1994 and any updated adopted versions hereinafter.
    (F) This section shall be monitored by the Board of Public Works and Safety and City Engineer's and Inspector's Offices.
